1. Introduction and Acceptance of Terms

Welcome to BAZAAR, a peer-to-peer marketplace for buying and selling goods and services using cryptocurrency. These Terms of Use ("Terms") govern your access to and use of the BAZAAR website, applications, and services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and all policies and guidelines incorporated by reference. If you do not agree to all of these Terms, you may not use the Platform.

2. The BAZAAR Platform

BAZAAR is an online marketplace that facilitates the exchange of goods and services between users using cryptocurrency. We do not own, sell, or inspect the items listed. Platform ensures the safety of each transaction by acting as a guarantor, subject to the conditions described in Section 4.
 The BAZAAR team moderates listings, confirms payments, and processes payouts. All core functions are executed within the controlled infrastructure of the Platform.
 

3. User Accounts and Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a binding contract. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account at any time for any reason.

4. Cryptocurrency Transactions

All transactions on BAZAAR are conducted exclusively in cryptocurrency. You are solely responsible for all aspects of your cryptocurrency transactions, including:

• Wallet Management: You are responsible for securing your digital wallet and any other credentials. We are not responsible for any loss of funds due to compromised wallets or user error.
• Transaction Fees: You are responsible for all network transaction fees (gas fees) associated with your cryptocurrency transactions.
• Irreversibility: Cryptocurrency transactions are generally irreversible. Once a transaction is broadcast on the blockchain, it cannot be canceled or reversed by BAZAAR.
• Volatility: You acknowledge and accept the high volatility and inherent risks associated with cryptocurrency values. We are not responsible for any financial loss resulting from changes in cryptocurrency prices.

5. Listing and Selling

Sellers on BAZAAR agree to:

• Provide accurate and complete descriptions of items, including condition, specifications, and any known defects.
• Clearly state the cryptocurrency and price for each item.
• Ship items in a timely manner after receiving full payment.
• Comply with all applicable laws and regulations regarding the sale of their items.

6. Buying and Payment

Buyers on BAZAAR agree to:

• Carefully review item descriptions and seller information before making a purchase.
• Only make a payment once you are certain about the purchase.
• Ensure that your wallet has sufficient funds to cover the purchase price and any transaction fees.
• Pay only to the wallet address provided at checkout
• Understand that once a payment is verified, it is final and non-refundable, unless otherwise decided under dispute resolution.

7. Prohibited Conduct and Content

You agree not to use the Platform to:

• Violate any laws, regulations, or third-party rights.
• List, buy, or sell illegal, stolen, or counterfeit goods.
• Engage in any fraudulent, deceptive, or misleading practices.
• Post defamatory, obscene, or harassing content.
• Distribute malware or other harmful code.
• Circumvent platform mechanisms or manipulate listing rankings or order flows.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAZAAR AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

10. Disputes between Users

Any disputes between buyers and sellers must be resolved directly between them.
However, BAZAAR may, at its discretion, provide basic mediation and investigation in cases involving:

• Unconfirmed or delayed payments;
• Non-delivery of items or services;
• Misrepresentation or fraud.

Users must submit dispute claims via support within 72 hours of the issue.
BAZAAR may request evidence from both parties and issue a binding decision.
Our decision is final within the scope of the Platform.

11. Indemnification

You agree to indemnify and hold harmless BAZAAR and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law rules.
All disputes shall be resolved exclusively in the courts located in England and Wales.
